Dasuki’s aide yet to gain freedom despite court order

Exactly one week after an Abuja High Court ordered the immediate release of Nicholas Ashinze, a special assistant to the former national security adviser, Sambo Dasuki, the Nigeria army colonel is yet to gain his freedom.
Ashinze, a serving army colonel was detained by the Economic and Financial Crimes Commission (EFCC) for four weeks from December 23, 2015, before he was transferred to continue his detention with the army.
He is alleged to be linked to the $2.1 billion arms deal saga involving Dasuki – former boss.
He later sued the army, the chief of army staff and the EFCC for an infringement on his human rights and withholding his personal documents since the day he was detained.
Following his suit, on Monday, March 14, Justice Halilu Yusuf had called the Nigeria army, the chief of army staff, Tukur Buratai and the EFCC to order.
In his ruling, Halilu said Ashinze should be release immediately until the institutions are set to arraign him before a court of competent jurisdiction over any allegation levelled against him.
The judge had also said: “The EFCC’s motto is nobody is above the law; but they are acting as if they are above the law here.”
He also advised the institution to operate within the ambit of law.
“The respondents have not behaved as if they live in a civilized society, they behaved like we are still in the military era,”Halilu said.
But one week after the judge’s ruling, a reliable source told Naij.com that the security institutions are yet to comply with the court’s order.
The source said: “He is still being detained up till now.”
However contrary to the claims, the spokesperson for the EFCC, Wilson Uwujaren told Naij.com that Ashinze is not with the EFCC.
Uwujaren simply said: “He is not with the commission.”
Also, the army spokesperson, Sani Usman confirming the EFCC’s claim said Ashinze is only being being restricted within the barrack.
this said: “Not correct, he is not under detention but restricted within the barrack just like any other officer since the investigation is ongoing.”
